Basic objectives of the privacy policy

The privacy policy defines the rules for the processing and protection of Users' personal data in connection with the operation of the app (further as „the App”) created by Albatros Golf Spółka z ograniczoną odpowiedzialnością with its registered office in Lublin, Frezerów 3, 20-209 Lublin, Poland, entered in the Register of entrepreneurs of the National Court Register kept by the District Court Lublin-Wschód in Lublin with its registered office in Świdnik, Court registry number: 0000857193, NIP (tax identification number): 9462699683, REGON (National Business Registry Number): 386864419.
The privacy policy contains the applicable rules for the collection and use of data by the website and App in connection with business lead by Albatros Golf Spółka z ograniczoną odpowiedzialnością.
Our primary goal is to provide our Clients and Users of our website and App with privacy protection at a level at least corresponding to the standards specified in applicable legal provisions, in particular in the Act of July 18, 2002 on the provision of electronic services (Dz. U. z 2002 r., Nr 144, poz. 1204 z późn. zm.), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR) and in the Act of 16 July 2004 Telecommunications Law (Dz. U. z 2004 r., Nr 171, poz. 1800 z późn. zm.).

The scope of collected data and information and the method of their use. Purpose and legal basis for their processing.

The Controller processes the following scope of the personal data of Users:
a. Email address,
b. Name and Surname,
c. Date of birth / age,
d. Sex,
e. Handicap (HCP = golf / sport value),
f. City,
g. Country,
h. Geolocation (permission for GPS location required),
i. Statistical and analytical data,
j. Trainings and injuries data,
k. Profile photo,
l. Data used to make online payments (in the case of subscription).
The Controller collects and processes personal data for the following purposes:
a) Exchange of correspondence, including email correspondence

The Customer's personal data will be processed for the purpose of exchanging correspondence, including email correspondence in the field of business activities conducted by the Controller. The content of the correspondence will be stored until the expiry of its usefulness, but not longer than 5 years.
b) Performance of mutual obligations and pursuing claims 

The Customer's personal data will be processed for the purposes of fulfilling the obligations between the Parties, in particular resulting from the concluded contract and enabling the use of the website and App, including:

- keeping data statistics and in-depth analytics,
- matching educational content (training) on the basis of statistical data (personalization of content),
- creating a community of the website and App users (if the User agrees to make the profile public),
- sharing sports data (results) with the website and App community,
- data history (results of games, training, statistical studies, recommendations).

The User's personal data will also be processed in order to perform the obligations arising from legal provisions (including those related to settlement), as well as - in the scope of the legally justified interest of the Collector - in order to establish, investigate or defend against claims, pursuant to Article 6 sec.1 letter “a”, “b” and Article 6 sec. 1 letter “c” and “f” GDPR. 

The period during which the data will be processed: 

Your personal data will be processed for the duration of the cooperation, as well as for the period indicated by law necessary to guarantee the possibility of considering any civil law claims that could arise in connection with the cooperation.
c) Marketing activities

The personal data of the Client / User will be processed for marketing purposes in cases related to directing the offer of products or services of the Data Collector. The basis for the processing of your personal data for marketing purposes is the consent expressed by the Client / User.

The period during which the data will be processed: 

Your personal data will be processed until the marketing consent is withdrawn. In other cases, for the time necessary to achieve the goal and for the period necessary to ensure the possibility of considering any civil law claims that could arise in connection with the subject of the consent.

Data recipients; Data transfer to third countries or international organizations; Profiling.

Personal data of the User / Client (only to the extent necessary) may been trusted to the Controller of personal data to the following categories of entities:

a. state authorities or other entities authorized under the law,
b. persons authorized by the Collector,
c. banks, if it is necessary to conduct settlements,
d. entities enabling us to carry out remote payment operations,
e. entities, partners (contractors) of our business implementations, inparticular producers of sports (golf) equipment, entities managing sports / golf facilities, professional golf associations.

Your personal data may be transferred outside the EU / EEA. In this case, the Collector undertakes to ensure the protection of the transferred data to the extent not less than that resulting from the provisions of the GDPR.

Based on the personal data of Users / Clients, the Collector makes automated decisions, including decisions resulting from profiling, to personalize the content of the website and App.

Users' rights in connection with the processing of their personal data.

In accordance with the applicable legal status, the User / Customer is entitled to:

a. the right to access your data and receive a copy of it;
b. the right to rectify (correct) your data;
c. the right to delete data. If, in the User's opinion, there are no grounds for us to process your personal data, the User may request that we delete them;
d. restriction of data processing. The User may request that we limit the processing of his personal data only to their storage or performance of activities agreed with him, if, in the User's opinion, we have incorrect data about you or we process it unreasonably; or you do not want us to remove them because they are needed to establish, assert or defend claims; or for the duration of your objection to data processing;
e. the right to object to data processing: "Marketing" objection. You have the right to object to the processing of your data for the purpose of direct marketing. If you exercise this right - we will stop processing your data for this purpose;
f. the right to data portability;
g. the right to lodge a complaint to the supervisory body - the President of the Personal Data Protection Office (2 Stawki St., 00-193 Warsaw, Poland);
h. the right to withdraw consent to the processing of personal data. In each case, the User has the right to withdraw consent to the processing of personal data that we process based on his consent. Withdrawal of consent will not affect the lawfulness of the processing that was carried out on the basis of the User's consent expressed before its withdrawal.
